Contested Wills
To be valid, a will must express the wishes of the testator with respect to the distribution of his or her estate upon death in writing. The common challenges to the validity of a will are:
1. the will was not properly signed;
2. the testator lacked testamentary capacity;
3. the testator did not have knowledge of or approve the contents of the will; and
4. the testator was unduly influenced.
Less frequently, wills are also challenged based upon allegation of forgery or fraud.
